Terms and conditions

The following General Terms and Conditions of Sale govern the offer and sale of products on our website (www.shirtfactory.it). Products purchased on www.shirtfactory.it are sold directly by SHIRT FACTORY (hereinafter, “we” or “the Seller“), with registered office in Italy at Via Guido D’arezzo 19, 20145 Milan, VAT number 11907730961, R.E.A. number MI 2631329. Please remember that you can always contact the Seller via email at the following address: shirtfactory@tiscali.it.

  1. It will be necessary to enter the address where you wish to receive the purchased items, as indicated in the appropriate section of the site.
    The system will not allow the order procedure to be completed if the user requests the shipment of the product to addresses to which the Seller cannot ship.
  2. Please pay attention to the information provided in said section, as the indications contained therein form an integral and substantial part of these General Terms and Conditions of Sale and, therefore, are considered to be fully known and accepted by you at the time the order form is transmitted.

1. Our commercial policy

  1. The Seller offers products for sale on www.shirtfactory.it and carries out its e-commerce activity exclusively towards its end users who are “consumers”.
  2. By “consumer” we mean any natural person acting on www.shirtfactory.it for purposes unrelated to their commercial, entrepreneurial, or professional activity, if any. If you are not a “consumer”, we invite you to refrain from entering into commercial transactions on www.shirtfactory.it.
  3. In consideration of its commercial policy, the Seller reserves the right not to process orders from subjects other than the “consumer” or any orders that do not comply with its commercial policy.
  4. These General Terms and Conditions of Sale exclusively govern the offer and sale of products on www.shirtfactory.it between consumers and the Seller.
  5. The General Terms and Conditions of Sale do not, however, govern the provision of services or the sale of products by parties other than the Seller who are present on www.shirtfactory.it via links, banners, or other hypertext links. We advise you, before submitting orders and purchasing products and services from parties other than the Seller, to verify the applicable terms of sale, as we will not be responsible for the provision of services by third parties other than the Seller nor for the conclusion of transactions between users of www.shirtfactory.it and third parties.

2. How to conclude the contract with the Seller

  1. The presentation of products on www.shirtfactory.it together with their prices does not constitute an offer, but rather an invitation to treat. If you wish to purchase one or more products on www.shirtfactory.it, you must submit an order by following the online purchase process, namely you must: (i) add the products to your shopping bag, (ii) click the “Proceed to checkout” button, (iii) enter your email address, (iv) fill out the order form with your personal data (first name, last name, address, email, telephone, shipping/billing address), (v) select the shipping and payment methods, (vi) accept these terms and conditions of sale, and (vii) submit the order form through the site.
  2. Before submitting the order form, you will be given the opportunity to verify and possibly correct any errors, and you will also be asked to carefully read these General Terms and Conditions of Sale and the Return Policy.
  3. By transmitting the order form to the Seller and concluding the contract, you unconditionally accept and undertake to observe the provisions contained in these General Terms and Conditions of Sale and in the Return Policy. Should you disagree with any of the provisions of these General Terms and Conditions of Sale or other provisions governing the relationship with the Seller contained in the Privacy Policy, we invite you not to submit the order for the purchase of products on www.shirtfactory.it.
  4. The order form will be stored in our database for the time necessary to process the order and in accordance with legal terms. You can access your order by clicking on the “My Account” section in the site menu.
  5. At the time the order form is transmitted, you will receive an automatic email acknowledging receipt of the purchase order (“Order Receipt Confirmation“), containing a summary of the information related to the order (namely, links to the General Terms and Conditions of Sale, a brief summary of the main characteristics of the products, including information regarding the price, payment methods, and shipping costs). The Order Receipt Confirmation does not, however, mean that the order has been accepted. All submitted orders are in fact subject to express acceptance by the Seller.
  6. The Seller reserves the right not to process purchase proposals for legitimate reasons, such as when there are insufficient guarantees of solvency, when orders are incomplete or incorrect, or when products are no longer available. In such cases, we will inform you via email (at the address provided in the order) that your purchase proposal cannot be processed, specifying the reasons. Should any of the aforementioned events occur, we will release any pre-authorized amounts without delay, where necessary.
  7. The contract shall be considered concluded only if and when you receive a communication via email confirming the shipment of the products (“Order Acceptance and Shipping Confirmation“).
    We will provide you with a summary of the applicable conditions, as well as a summary of the main characteristics of each product ordered and the relative price (including all applicable taxes and duties), the type of payment used for the purchase of each product, the delivery methods for the purchased products, the shipping costs, as well as the Seller’s details and our contact information (including geographical address and email address).
  8. You agree to receive the purchase receipt in electronic format.
  9. The official language of the country from which the purchase is made is the language used for the conclusion of contracts with the Seller.

3. Guarantees, indication of item prices, and legal warranty

  1. On www.shirtfactory.it we offer for sale only products marked with trademarks owned by Shirt Factory.
  2. The Seller does not sell second-hand products or defective products on www.shirtfactory.it.
  3. The essential characteristics of the products are listed on www.shirtfactory.it within each product sheet. Despite our commitment to allow you to view images that correctly and accurately reflect the products offered for sale on www.shirtfactory.it, such images and colors might nonetheless not correspond to the real ones due to the Internet browser and monitor used. Please refer to the description included in each product sheet.
  4. Product prices are indicated on the site www.shirtfactory.it and are inclusive of VAT or other applicable taxes. However, prices do not include delivery costs which, where applicable, will be added to the price of the products and will be communicated to you during the purchase process.
  5. Prices may be subject to change. Please verify the final sale price before submitting the relative order.
  6. All products sold by the Seller are covered by the legal warranty of conformity.

4. Payments

  1. Payment of the price of the products and the relative shipping and delivery costs must be made using one of the procedures available on the site www.shirtfactory.it, as indicated in the order form.
  2. In case of payment by credit/debit card, financial information (for example, the credit/debit card number or its expiry date) will be forwarded, via encrypted protocol, to Banca Unicredit or other banks providing the relative remote electronic payment services, without third parties being able to have access to it in any way.
    Furthermore, such information will never be used by the Seller except to complete the procedures related to your purchase and to issue the relative refunds in case of any product returns following the exercise of your right of withdrawal. The price for the purchase of the products and the shipping costs, as indicated in the order form, will be charged to your current account at the time of the actual shipment of the purchased products.
